The comment focused on the extent to which the Bill is in conflict with the rule of law and therefore with the requirements of South Africa’s Constitution. It proposed that the Bill should be returned to the drafters for reconsideration.

On Friday, 13 September Leon Louw and Temba Nolutshungu gave oral evidence on the Bill to the Parliamentary Portfolio Committee on Minerals, in which they elaborated on the concerns regarding the extent to which the Bill does not meet the rule of law requirements of the Constitution.
